Update

Thank you for patiently waiting for an update. We appreciate all of the concern, sweet comments, and emails. Truly they keep us going somedays.

Update:
Court on Tuesday did not happen as planned. We received a phone call late Monday night stating court had been canceled due to a judge family emergency. We did not feel like things added up and showed up to court anyways. Our gut feelings paid off. The judge was there, but the two attorneys were not. Court obviously could not proceed without counsel available. The judge called and spoke with both attorneys on Tuesday and presented that Jake is the biological father. The judge ordered ONCE again, that our case has to be adjoined with the adoptive case. He also had ordered this back in May, which failed to happen. A delay tactic on part from the opposing counsel. We now know we are up against Larry Jenkins, who is representing the prospective adoptive couple. He has a strong part in the adoption laws created in the state of Utah and has won every case against unwed biological fathers so far. It's going to be a strong uphill battle, but we feel like our case is just slightly different than the others because we are in the state of UTAH, the mother is in the state of Utah and the baby was born in the state of Utah. We have supporting evidence such as over 800 text messages, emails, key witnesses, photos, copies of money orders and reciepts, etc.

Moving forward, we will have two upcoming court dates. We are waiting to hear if we will be heard in 3rd District or 2nd District court and we are waiting to go before the commissioner to be granted temporary custody orders. This battle is long and the process is painful. We are praying for the day that we can meet our sweet baby boy. Our lives are on hold and we won't give up on you Jackson!

  1. I am sorry to hear Larry Jenkins is involved in yet another one of these horrible adoption cases. I don't know how that man sleeps at night with all the pain he has caused innocent families.

  2. You know whats sad, is that this adoptive family one day will have to explain the reasoning for not letting his own father take him when he was fighting for him back! Baby jack will have resentment towards them just watch! And for those stupid people sayin oh your ruining the adoptive families life your ruining jacks life. He is only 6 months old! He doesnt even know whats going on. And hopefully by time he knows whats going on he will be in his biological fathers arms!! You people make me sick this is not right and i hope justice is served!!! To the couple! Your not his parents you never will be!!! You dont even have the same dna!! Give him back already!!!

  3. Baby jack should be returned to his father ASAP. For Larry Jenkins to go into a court room and stand against a father you was unwed when the child was born is WRONG. Only God has the right to judge us for our actions. That his Jakes son! For the adoptive family to take a stand with a child they know was wrongfully given up is WRONG! Utah's adoption laws are primitive and prejudice. Hold the mother accountable for her actions, for the pain and torture she has caused! And give the child back to his family! His BIOLOGICAL family!
